Can any legal action be taken against the NHS for breach of it's responsibility to pay as per the DT, and for introducing a system it knew would not be accurate. Can Pharmacy Voice, or even C&D set up a fund to take legal advice and pursue further. It is obvious a softly softly approach via the PSNC will not bring about the desired result in an adequate timescale, if at all. For the NHS to say we would have to continue to suffer errors in payment until it conducts a full busines review of the BSA is wholly unacceptable. It will continue to delay matters, as it has with control of entry, to cause further financial loss to contractors. I realise a legal approach will cost, but it tells the NHS we will not be trodden over and we demand to be treated with respect and with fairness.
