Lloydspharmacy loses battle to block 100-hour pharmacy on same site

Business Leeds GP surgery successfully appealed Leeds City Council’s decision to prevent it from extending its building

A surgery-based Lloydspharmacy branch has lost its battle to prevent GPs opening a 100-hour pharmacy under the same roof.


Manor Park Surgery in Bellmount Close, Leeds successfully appealed Leeds City Council's decision to prevent it from extending its building with extra consultation rooms, an optician and a 100-hour pharmacy.


The application was initially blocked in November 2012, when the council agreed with Lloydspharmacy, which is also based in the surgery, that there were elements of the application that should be "more fully considered", according to a report submitted to Leeds Council last week (January 30).

However, in a hearing at Leeds High Court in December last year, the judge threw out all eight of Lloyds' objections. This included Lloyds' claim that the surgery's application had been "misleading" because it wanted to use a new pharmacy to fund improvements to other parts of the building.


The judge also upheld the surgery's claim that it needed a 100-hour pharmacy on site and prevented Lloyds from appealing his decision.


During the original application process, concerns were raised about the impact a 100-hour pharmacy would have on the existing Lloydspharmacy branch. The surgery responded that extended operating hours and additional services were required by the PCT.


The surgery had approached Lloydspharmacy to see if it wanted to occupy the new premises and offer enhanced services with extending opening hours, but the branch was "apparently unwilling to relocate", according to council documents. Two of the surgery's GPs have shares in the new pharmacy, according to its website.


Following the decision, Leeds Council was working to ensure that future building applications were "robust enough" to stand up to the level of scrutiny that the surgery pharmacy application had received, it said in its report.


Lloydspharmacy declined to comment on the decision.
